Registered office: 305 rue du Faubourg Saint-Antoine, 75011 Paris, France.

2. Purpose and Scope

These Terms govern the sale of products by TAMMY & BENJAMIN to consumers through its website.

They apply to online orders, including in-stock items, pre-orders, Responsible Production items, and products offered under special commercial conditions.

Purchases made directly in the boutique may be subject to different conditions, particularly regarding the statutory right of withdrawal, which does not automatically apply to purchases concluded in-store.

Nothing in these Terms excludes mandatory consumer protection provisions applicable to customers, including those in their country of residence.

The applicable Terms are those communicated when the order is confirmed. They may be amended for future orders without retroactively changing existing contracts.

3. Products and Characteristics

Essential product characteristics are presented on the relevant product pages, including the model, dimensions, materials, color, included accessories, and any special manufacturing conditions.

Photographs and visuals are intended to represent products accurately. Slight variations in color or appearance may result from screen settings, lighting, the natural characteristics of leather, or artisanal manufacturing.

Such variations do not override statutory conformity requirements or characteristics expressly agreed upon when placing the order.

Included accessories are those specified on the product page. Accessories shown in lifestyle photographs are not necessarily included.

4. Product Availability

Products are offered subject to availability or production capacity.

Immediate availability and manufacturing after an order is placed are distinguished on the relevant product pages.

If an item becomes unavailable after order confirmation, TAMMY & BENJAMIN will inform the customer promptly and offer, as appropriate, an alternative solution, a revised timeframe accepted by the customer, or cancellation with a refund of the amounts due.

No replacement model or color will be imposed without the customer's agreement.

5. Prices and Taxes

Prices are displayed in the currency offered for the selected country or market, with applicable taxes according to the information presented to the customer.

Any shipping fees are disclosed before final order confirmation.

For deliveries within the European Union, prices include applicable VAT.

For deliveries outside the European Union, customs duties, import taxes, or customs clearance charges may be requested by local authorities or carriers. Unless expressly stated otherwise at checkout, these charges are not included in the price and remain payable by the recipient.

Prices may be changed at any time for future orders. The price applicable to an order is the one confirmed at checkout, subject to applicable rules concerning obvious pricing errors.

Discounts, promotional codes, and commercial offers are subject to their stated conditions and may not be combined.

6. Ordering Process

Customers select the products they wish to purchase, verify their quantities and characteristics, and provide the information required for billing, payment, and delivery.

Before final confirmation, an order summary allows customers to review the products, prices, applicable fees, and contact details, and to correct any errors.

Confirming an order through a button clearly indicating the payment obligation constitutes an order with an obligation to pay and acceptance of these Terms.

An order confirmation is sent to the email address provided by the customer.

Customers must provide accurate and current information. If a shipping address is incorrect, they should contact Customer Service immediately.

TAMMY & BENJAMIN may carry out reasonable fraud prevention checks and refuse an order for legitimate reasons in accordance with applicable law.

7. Payment

Accepted payment methods are those displayed at checkout.

Payment is made according to the arrangements presented when placing the order. Installment payment options, where available, are subject to the relevant provider's conditions, disclosed before the customer enters into the arrangement.

Payment transactions are processed by specialized payment providers. TAMMY & BENJAMIN does not retain complete payment card details.

If payment is declined or the transaction fails, the order may not be confirmed.

8. Contract Formation and Evidence

The sales contract is concluded through the ordering and confirmation process presented on the website, subject to applicable law.

Electronic confirmations, invoices, and transaction records retained under reasonable security conditions may be used as evidence.

Consumers retain the right to challenge such evidence through legally admissible means.

Contractual records are retained in accordance with statutory archiving requirements. Customers may request a copy of their order information from Customer Service.

9. Pre-orders

Some products may be ordered before they are immediately available.

Where applicable, the product page indicates an estimated manufacturing or availability period.

Manufacturing takes place in Italy through our partner workshops. Items then undergo final quality control in Paris before dispatch.

Estimated timeframes may change due to production constraints, without prejudice to expressly agreed delivery commitments or customers' statutory rights.

In the event of a significant delay, customers will be informed and may exercise the remedies provided by law.

The fact that an item is manufactured after an order is placed does not, by itself, make it a personalized product excluded from the statutory right of withdrawal.

10. Responsible Production

The Responsible Production selection is based on planned manufacturing volumes intended to limit overproduction.

Eligible products are offered at a preferential price in exchange for a manufacturing period generally estimated at approximately 24 days before dispatch, depending on the model and production schedule.

These items benefit from the same craftsmanship, quality standards, and final quality control in Paris as the Maison's other products.

The preferential price and manufacturing timeframe are communicated before purchase.

Responsible Production items benefit from statutory withdrawal rights, conformity guarantees, and applicable warranties. Manufacturing after an order is placed does not, by itself, constitute personalization under the law.

11. Shipping Destinations and Methods

Available shipping destinations and delivery methods are presented at checkout.

Depending on the destination and selected service, TAMMY & BENJAMIN may use DHL Express, FedEx, Colissimo, or Mondial Relay.

Any restrictions concerning post office boxes, parcel lockers, or pickup points are specified where necessary.

Shipping fees are disclosed before order confirmation. Complimentary shipping may be offered depending on the country, delivery method, or current commercial conditions.

12. Order Preparation and Delivery Times

For in-stock items, preparation before dispatch generally takes 1 to 3 business days.

Pre-orders, Responsible Production, and certain personalized products require additional manufacturing or preparation time.

Estimated shipping transit times from dispatch are generally:

  • Mainland France: 2 to 5 business days.
  • European Union: 3 to 5 business days.
  • United Kingdom: 2 to 3 business days.
  • North America: 2 to 5 business days.
  • Asia and Middle East: 2 to 5 business days.
  • Other destinations: depending on the country and carrier.

These estimates do not replace the contractually agreed delivery date or period.

Where the contract does not specify a delivery date or period, the seller must deliver without undue delay and no later than 30 days after the contract is concluded, under the conditions provided by the French Consumer Code.

Customers generally receive a tracking link after dispatch.

For further information, please consult our Shipping Policy.

13. Delivery Delays

In the event of a delay, customers may contact Customer Service for information about their order.

If delivery does not occur within the agreed or applicable statutory period, consumers may, under the conditions provided by law, request delivery within an additional reasonable period.

If delivery does not take place within that additional period, consumers may terminate the contract in accordance with the law and obtain a refund of the amounts due.

In cases provided by law, including where the delivery date was an essential condition of the contract, termination may occur without first granting an additional period.

Difficulties experienced by a carrier do not remove the seller's statutory obligations.

14. Customs and Imports

International shipments may be subject to customs procedures.

Customs duties, import taxes, and customs clearance fees not expressly included when placing the order are payable by the recipient.

The amount depends on the regulations of the destination country and may be collected by customs authorities or the carrier.

Any special commercial offers relating to duties or taxes are subject to the conditions expressly communicated to the customer.

Refusal to pay import charges does not automatically remove obligations arising from the order or consumers' statutory rights. Cancellation and return requests are assessed according to the circumstances and applicable law.

15. Transfer of Risk and Receipt

The risk of loss or damage passes to the consumer when they, or a third party designated by them other than the carrier proposed by the seller, take physical possession of the goods.

Applicable legal exceptions remain in force, including where a carrier is selected independently of those proposed by the seller.

Customers are invited to inspect parcels upon receipt and report any issues promptly.

Failure to make reservations with the carrier does not deprive customers of statutory warranties or remedies against the seller.

16. Lost, Damaged, or Incomplete Parcels

In the event of a lost parcel, shipping damage, missing item, or packing error, customers may contact Customer Service with their order number and photographs where possible.

TAMMY & BENJAMIN will review the situation, conduct appropriate checks with the carrier, and propose a solution consistent with the customer's rights.

Where the seller is responsible for proper delivery, a carrier investigation cannot remove the consumer's statutory rights.

Where goods are non-conforming or a delivery error is attributable to the seller, the costs necessary to bring the order into conformity are covered in accordance with the law.

17. Statutory Right of Withdrawal

For eligible distance sales, consumers have a statutory period of 14 calendar days from receipt of the goods to exercise their right of withdrawal without giving a reason.

Where several items from the same order are delivered separately, the period generally begins upon receipt of the final item.

To exercise this right, consumers must inform TAMMY & BENJAMIN of their decision before the deadline through an unambiguous statement.

This statement may be sent by email to cs@tammyandbenjamin.com or by post to TAMMY & BENJAMIN, 33 rue de Poitou, 75003 Paris, France.

Consumers may also use the model withdrawal form included at the end of these Terms.

Simply returning a parcel without a withdrawal statement, or refusing delivery, is not sufficient on its own to exercise this right.

Consumers must return the goods within 14 days after communicating their decision to withdraw.

They may handle items to the extent necessary to establish their nature, characteristics, and functioning, as they would in a boutique.

Consumers may be liable for any reduction in value resulting from handling beyond what is necessary, under the conditions provided by law.

The absence of original packaging does not, by itself, eliminate the statutory right of withdrawal.

18. Exceptions to the Right of Withdrawal

The statutory right of withdrawal does not apply to contracts falling within the exceptions established by Article L221-28 of the French Consumer Code.

In particular, products made to the consumer's specifications or clearly personalized may be excluded.

This exception does not automatically apply to standard products manufactured after an order is placed, pre-orders, or Responsible Production items.

Sale items, Archives, Clearance Sale, and Second Life products remain subject to the statutory right of withdrawal where no legal exception applies.

19. Commercial Returns Within 30 Days

In addition to the statutory right of withdrawal, TAMMY & BENJAMIN offers a commercial return period of up to 30 days after receipt.

For returns requested between days 15 and 30, items must be unused, unworn, undamaged, and returned complete in their original condition and packaging, together with all included accessories.

Clearly personalized items are not eligible for commercial returns due to a change of mind.

Specific conditions for Archives, Clearance Sale, Atelier Sale / Private Sale, and Second Life are detailed below.

This commercial policy does not restrict consumers' statutory rights.

20. Return Shipping Costs

For voluntary returns from mainland France and Belgium, TAMMY & BENJAMIN provides a prepaid return label upon request to Customer Service, except for selections subject to specific exclusions.

Voluntary return shipping costs for Archives, Clearance Sale, Atelier Sale / Private Sale, and Second Life items remain payable by the customer.

For voluntary returns from other countries and overseas territories, direct return shipping costs are payable by the customer.

In the event of an error attributable to TAMMY & BENJAMIN or a defect covered by a statutory warranty, the necessary costs are covered in accordance with applicable regulations.

Customers may also return items to our boutique at 33 rue de Poitou, 75003 Paris, without shipping fees.

Any prepaid return label provided by Customer Service must be used according to the communicated instructions, including its validity period.

21. Return Address and Procedure

To facilitate processing, customers are invited to contact Customer Service before shipping a return.

Address:
TAMMY & BENJAMIN
Returns Department
33 rue de Poitou
75003 Paris
France

The order number must be included in the parcel. Accessories provided with the item must be returned where they form part of the relevant product.

For returns arranged directly by the customer, tracked shipping is recommended. Customers are invited to provide the tracking number to Customer Service.

Prior authorization from the seller is not a condition for exercising the statutory right of withdrawal.

22. Refunds

In the event of statutory withdrawal, TAMMY & BENJAMIN refunds the amounts legally due without undue delay and no later than 14 days after notification of the withdrawal decision.

The seller may defer the refund until the goods have been recovered or proof of return shipment has been received, whichever occurs first.

Original delivery charges are refunded under the conditions provided by law. Additional charges resulting from the selection of a delivery method more expensive than the standard option offered are not necessarily refundable.

Refunds are made using the payment method used for the original transaction, unless the consumer expressly agrees to another method that does not incur additional fees.

For commercial returns accepted after the statutory withdrawal period, refunds are generally issued within 14 days following receipt and inspection of the product, subject to applicable special conditions.

The time required for the refund to appear in the customer's bank account may depend on the payment provider or bank.

For discounted items, the refund corresponds to the amount actually paid.

23. Exchanges

Requests to exchange a model or color may be made within 30 days of receipt, subject to the applicable return conditions and stock availability.

An exchange may require a price adjustment. If the replacement item is manufactured after the order is placed, its estimated lead time is communicated to the customer.

Commercial exchanges do not limit statutory rights to repair, replacement, price reduction, or contract termination under applicable warranties.

24. Special Conditions: Archives and Clearance Sale

Items offered in the Archives and Clearance Sale selections benefit from the statutory 14-day right of withdrawal and, subject to applicable commercial conditions, the possibility of returns within 30 days.

Voluntary return shipping costs remain payable by the customer, including for returns from mainland France and Belgium.

Discounts do not remove statutory warranty rights.

25. Special Conditions: Atelier Sale and Private Sales

Products offered during an Atelier Sale or Private Sale may be subject to specific commercial conditions disclosed before purchase.

Voluntary return shipping costs remain payable by the customer.

Where a sale is concluded remotely, the statutory right of withdrawal applies, subject to legal exceptions.

Purchases concluded physically in a boutique or during an in-person event do not automatically benefit from the statutory right of withdrawal applicable to distance sales.

Atelier Sale / Private Sale items are excluded from the additional one-year commercial warranty but retain applicable statutory warranties.

26. Special Conditions: Second Life

Second Life items are offered according to their condition and the characteristics expressly described on their product pages.

Any signs of use or particular characteristics disclosed before the sale are taken into account when assessing conformity, under the conditions provided by law.

Second Life items purchased remotely benefit from the statutory 14-day right of withdrawal and statutory warranties applicable to second-hand goods.

For voluntary returns accepted between days 15 and 30 after receipt, customers receive store credit valid for one year instead of a monetary refund.

Voluntary return shipping costs remain payable by the customer.

Second Life items are excluded from the additional one-year commercial warranty, without prejudice to statutory warranties.

27. Personalized Products

Certain products may be personalized, including through initials or markings.

Customers are invited to carefully check the information entered before confirming their order.

Where a product is made to the consumer's specifications or clearly personalized, the statutory right of withdrawal may be excluded under Article L221-28 of the French Consumer Code.

This exclusion does not remove the customer's rights in the event of a lack of conformity, manufacturing defect, or error attributable to the seller.

28. Statutory Warranties

TAMMY & BENJAMIN is bound by applicable statutory warranties independently of any commercial warranty.

Statutory guarantee of conformity: consumers generally have two years from delivery of the goods to make a claim concerning a lack of conformity, in accordance with Articles L217-3 and following of the French Consumer Code.

Under the conditions provided by law, consumers may obtain repair or replacement without charge or significant inconvenience. Where the legal conditions are met, they may request a price reduction or termination of the contract.

The periods during which a defect is presumed to have existed at delivery vary, in particular, depending on whether the goods are new or second-hand.

Warranty against hidden defects: under Articles 1641 and following of the French Civil Code, consumers may bring a claim concerning a hidden defect that makes goods unfit for their intended purpose or substantially reduces their usability.

Claims must generally be brought within two years of discovering the defect, under the conditions provided by law.

Depending on the applicable legal circumstances, consumers may request termination of the sale or a price reduction.

Statutory warranties also apply to sale items, pre-orders, Responsible Production, and special selections, according to the rules applicable to each category.

29. Regulatory Information on the Statutory Guarantee of Conformity

Consumers have two years from delivery of the goods to request implementation of the statutory guarantee of conformity in the event of a defect.

Under the conditions provided by law, this guarantee entitles consumers to repair or replacement within 30 days of their request, without charge or significant inconvenience.

If goods are repaired under this guarantee, the original guarantee is extended by six months.

If a consumer requests repair and the seller imposes replacement, a new two-year guarantee period begins from replacement.

Any period during which goods are unavailable for repair or replacement suspends the remaining guarantee period until the goods are returned.

In situations provided by law, particularly where bringing goods into conformity is impossible, refused, or not completed under the required conditions, consumers may obtain a price reduction or terminate the sale.

Consumers also benefit from the warranty against hidden defects under Articles 1641 to 1649 of the French Civil Code.

These rights arise in particular from Articles L217-1 to L217-32 of the French Consumer Code.

30. Commercial Warranty Against Manufacturing Defects

In addition to statutory warranties, TAMMY & BENJAMIN offers a complimentary one-year commercial warranty against manufacturing defects affecting eligible products under normal use.

Guarantor: TAMMY & BENJAMIN SAS, 305 rue du Faubourg Saint-Antoine, 75011 Paris, France.

Warranty contact: TAMMY & BENJAMIN, 33 rue de Poitou, 75003 Paris, France; cs@tammyandbenjamin.com; +33 (0)1 40 56 05 39.

Duration: one year from delivery of the product.

Cost: complimentary.

Coverage: countries to which TAMMY & BENJAMIN delivers eligible products.

This warranty covers manufacturing defects and excludes normal wear and tear, accidental damage, impacts, scratches or stains resulting from use, damage caused by improper use, incorrect care, water, heat, chemicals, or inappropriate interventions.

Second Life and Atelier Sale / Private Sale items are excluded from this additional commercial warranty.

To request assistance, customers may contact Customer Service with their order number, a description of the defect, and photographs where possible.

The proposed solution depends on assessment of the product and the warranty conditions, without prejudice to statutory warranties.

The commercial warranty does not replace or reduce statutory warranties.

31. After-Sales Service and Repairs

TAMMY & BENJAMIN offers after-sales assistance to review requests concerning the Maison's products.

Where an issue falls within an applicable statutory or commercial warranty, assistance is arranged in accordance with the customer's rights.

Outside these warranties, a paid repair may be offered, subject to technical feasibility and replacement-part availability.

A quotation or repair proposal is provided before any paid work.

No paid repair is undertaken without the customer's prior agreement.

Customers are invited not to ship products for repair before receiving instructions from Customer Service.

32. Order Modifications and Cancellations Before Dispatch

Customers may contact Customer Service to request an order modification or cancellation before dispatch.

The ability to accommodate such a request depends on the progress of preparation, manufacturing, or personalization.

A commercial modification or cancellation request does not affect statutory rights concerning withdrawal, delivery, or conformity.

33. Liability

TAMMY & BENJAMIN is responsible for fulfilling its contractual obligations under the conditions provided by law.

Nothing in these Terms is intended to exclude statutory warranties, remove mandatory consumer remedies, or exempt the seller from liability that cannot legally be excluded.

34. Force Majeure

Force majeure is assessed under Article 1218 of the French Civil Code and other applicable provisions.

An event does not automatically constitute force majeure merely because it involves a strike, adverse weather, transport disruption, or supply difficulty.

Its effects on contract performance are determined according to the legal criteria and consequences.

35. Personal Data

Personal data collected in connection with orders is processed in accordance with applicable regulations.

The purposes, legal bases, retention periods, and individual rights are described in our Privacy Policy.

For questions concerning personal data, customers may contact cs@tammyandbenjamin.com.

Consumers' rights concerning out-of-court dispute resolution remain applicable in accordance with current regulations.

37. Applicable Law and Competent Courts

If an amicable resolution cannot be reached, disputes shall be brought before the competent courts in accordance with applicable legal rules.

Nothing in these Terms imposes exclusive jurisdiction on consumers in violation of their rights.

38. Partial Invalidity

If any provision of these Terms is declared invalid or unenforceable, the remaining provisions shall continue to apply to the extent permitted by law.

Failure by either party to immediately invoke a right or contractual breach does not constitute a permanent waiver of that right.
